Please read these Terms of Service ("Terms") carefully before using our Website, booking a cruise, or purchasing any travel-related services. By accessing or using our Website or services, you ("User," "Passenger," or "Customer") agree to be bound by these Terms and our [Privacy Policy]. 1.Purpose

ix Star Travel Group is an e-commercewebsite intended to helpCanadiancruise travelers plan and book luxury ocean and river cruises.

2. Agency Role & Third-Party Suppliers

2.1 Intermediary Status

Company acts solely as an independent travel agent and booking broker between you and third-party cruise lines, airlines, hotels, tour operators, excursion providers, and transportation suppliers (collectively, "Third-Party Suppliers"). Company does not own, operate, manage, or control any cruise ship, vessel, hotel, aircraft, or excursion.

2.2 Independent Contracts

When you book a cruise through our Website, your purchase creates a direct contractual relationship with the respective cruise line (e.g., Royal Caribbean, Carnival Cruise Line, Norwegian Cruise Line, Celebrity Cruises, MSC Cruises, Princess Cruises, etc.). All bookings are subject to the specific terms, conditions, cancellation policies, and Passenger Ticket Contracts of the cruise line operating the vessel.

3. Bookings, Payments, & Pricing

3.1 Accuracy & Availability

All cruise itineraries, stateroom availability, pricing, promotions, and inclusions displayed on the Website are subject to change without prior notice until a booking is confirmed with a deposit and official confirmation number issued by the cruise line.

3.2 Prices, Taxes, & Port Fees

  • Quoted rates are typically per person based on double occupancy unless explicitly stated otherwise.
  • Total prices include cruise fare, governmenttaxes, fees, and port charges.However, cruise lines reserve the right to re-assess fuel surcharges, government taxes, or fee adjustments prior to departure.

3.3 Payment Processing

By providing credit card or payment information, you authorize Company and/or the applicable cruise line to charge your account for the required deposit or full balance on the scheduled payment dates. Failure to make final payments by the cruise line's designated due date may result in automatic cancellation of your reservation and forfeiture of non-refundable deposits.

4. Cruise Line Passenger Ticket Contracts

4.1 Binding Passenger Agreement

By booking through Company, you acknowledge and agree that your cruise is governed by the operating cruise line’s Passenger Ticket Contract(or Cruise Contract). The Passenger Ticket Contract governs key legal rights, including but not limited to:

  • Boarding and health rules.
  • Strict claims notice deadlines (typically 6 months) and maritime legal suit limitations (typically 1 year).
  • Forum selection clauses requiring litigation in specific jurisdictions (e.g., U.S. District Court for the Southern District of Florida).
  • Limitations on vessel liability under international maritime law and the Athens Convention.

It is your sole responsibility to review and accept the operating cruise line's Passenger Ticket Contract prior to embarkation.

5. Passports, Visas, & Travel Documentation

5.1 Passenger Responsibility

It is the sole responsibility of the Passenger to verify, obtain, and present all valid travel documentation required for entry into every country, port of call, and territory visited during the cruise. This includes, but is not limited to:

  • Valid passports (typically required to have at least six (6) months validity beyond your return date).
  • Visas, re-entry permits, or Electronic Travel Authorizations (eTA/ESTA).
  • Birth certificates and government-issued photo IDs (for closed-loop U.S. cruises, where permitted).
  • Health certificates, vaccination documentation, or medical clearances.

5.2 Denied Boarding

Neither Company nor the cruise line shall be liable or issue refunds if you are denied boarding, delayed, or deported due to improper, missing, or expired travel documentation.

6. Cancellations, Refunds, & Modifications

6.1 Cruise Line Cancellation Policies

All cancellations, stateroom changes, and itinerary modifications are subject to the penalty schedules established by the operating cruise line. Cancellation penalties typically increase as the departure date approaches, up to 100% ofthe cruise fare.

6.2 Agency Service Fees

In addition to cruise line fees, Company reserves the right to charge non-refundable administrative or service fees for booking alterations, cancellations, or complex itinerary adjustments as outlined in our fee schedule at the time of booking.

6.3 Refund Processing

Refunds (if applicable) will be issued only after funds are returned to Company by the cruise line or supplier. Payments made via credit card will be refunded to the original form of payment.

7. TravelInsurance & Protection Plans

7.1 Recommendation

Company strongly recommendsthat every passenger purchase comprehensive Travel Protection/Travel Insurance at the time of booking. Standard cruise tickets are non-refundable near departure, and cruise lines rarely grant medical exceptions.

7.2 Coverage

A suitable policy should cover trip cancellation, trip interruption, emergency medical evacuation, lost or delayed baggage, and travel delays. Company is not an insurance carrier. Insurance products are underwritten by third-party insurers, and all claims must be directed to the insurance provider.

8. Limitation of Liability & Disclaimers

8.1 Third-Party Supplier Actions

COMPANY SHALL NOT BE LIABLE FOR ANY ACT, OMISSION, ERROR, BREACH OF CONTRACT, NEGLIGENCE, INJURY, DEATH, PROPERTY DAMAGE, DELAY, CANCELLATION, OR OVERBOOKING CAUSED BY ANY CRUISE LINE, AIRLINE, HOTEL, SHORE EXCURSION OPERATOR, OR OTHER THIRD-PARTY SUPPLIER.

8.2 Force Majeure

Company shall not be liable for any failure, delay, or alteration of travel schedules caused by acts of God, extreme weather, hurricanes, maritime disasters, mechanical failures, wars, terrorism, civil unrest, government restrictions, quarantines, epidemics, or any other event beyond our reasonable control.

8.3 Maximum Liability

To the fullest extent permitted by applicable law, Company's total cumulative liability arising out of or related to your use of this Website or services shall not exceed the total amount of commissions or agency service fees received by Company for your specific booking.

9. Website Use & Intellectual Property

9.1 Permitted Use

You may use this Website solely to research cruise travel options, make legitimate reservations, and review travel content. You agree not to:

  • Make speculative, false, or fraudulent bookings.
  • Use automated systems (bots, scrapers) to extract data from the Website.
  • Reproduce, modify, or resell any content or software obtained through the Website.

9.2 Intellectual Property

All text, graphics, logos, images, software, and brand assets on this Website are the property of Company or its licensors and are protected by United States and international copyright and trademark laws.

10. Governing Law, Venue, & Dispute Resolution

These Terms and any dispute, controversy, or claim arising out of or relating to your use of this Website or services shall be governed by and construed in accordance with the laws of the Province of Onatario, without regard to its conflict-of-law principles.

10.2 Mandatory Forum Selection

You irrevocably agree that any legal action, suit, or proceeding arising out of or related to these Terms or Company's services shall be instituted exclusively in the provincial courts located in Ontario Canada.You hereby consent and submit to the personal jurisdiction of such courts.

10.3 Class Action Waiver

YOU AGREE THAT ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS AND THAT YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST COMPANY.

11. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms constitute the entire agreement between you and Company regarding the subject matter herein.
